This Privacy Policy describes how Omni Hotels & Resorts® and its affiliates and subsidiaries (“Omni,” “we,” or “us”) collect, use, and share personal information, and describes the rights and choices you may have with respect to your personal information, and how to assert those rights. We use information about you to fulfil our commitment to providing you a great guest experience.

By accessing, visiting, or using our Services (as defined below), you acknowledge this Privacy Policy and if you are an Omni customer you agree to our Terms of Use. If you are not comfortable with any part of this Privacy Policy or do not agree with the applicable Terms, please immediately discontinue access or use of our Services.

1. Scope and Applicability

This Privacy Policy applies to all personal information that is collected by Omni during any written, electronic, and oral communications online or offline when you:

  • interact with our websites, pages, features or content that link to this Privacy Policy, such as https://www.omnihotels.com/ (collectively, the "Sites");
  • use software applications that we make available for use on or through computers and mobile devices (the “Apps”) that link to this Privacy Policy;
  • otherwise interact with us, such as when you visit one of our properties, use the goods, services and amenities at one of our properties, become a loyalty program member (i.e., a Select Guest® Member), contact our customer service, or participate in our surveys or promotions (collectively, the “Activities”);
  • interact with social media pages that we control ("Social Media Pages"); or
  • engage our products or services that link to this Privacy Policy (collectively, including the Sites, Apps, Activities, and Social Media Pages, the “Services”).

You do not have to provide us with your personal information in order to use our Site; however, in some cases we may not be able to provide services to you without your personal information (for example, we would not be able to complete a requested booking or enroll you in our loyalty program). 

This Privacy Policy does not apply to the personal information we collect from California employees, contractors, or job applicants of Omni. If you are applying for a job with us, please see our Applicant Privacy Policy.

2. Information We Collect

We collect personal information directly from you, about you from other persons or entities, and automatically as you use our Site and Services.  Below is a description of the personal information we collect and how we use it.

  • Room Reservations

    Directly From You. When you make a reservation at an Omni property, we collect your first and last name, email address, postal address, payment information, reservation information, and accommodation preferences. That information is collected directly from you when you make a room reservation. If you choose not to provide this information, we may be unable to complete your request.  We may also collect your loyalty program member number, and in some instances we may receive information about a guest’s health. For example, a guest may voluntarily choose to provide information about a disability as part of a request for an accommodation preference. In certain circumstances, such as confirming reservation details or changes, we may also collect your government-issued identification information or your date of birth.

    If you provide personal information to us about other persons when making a booking or during your stay, for example, family members or colleagues, we ask you to make sure it is acceptable to them that their personal information be disclosed to us and to direct them to read this Privacy Policy for information about how we use their information.

    Automatically. When you make reservations, or anytime you use our Site or visit our social media sites, we collect information about you automatically such as your web request, Internet Protocol (“IP”) address, browser type, domain names, referring and exit pages and URLs, pages viewed and the order of these page views, the date and time you access our servers, and other diagnostic data. This information is collected for functional purposes and to improve your experience. This information may also be used for fraud prevention, aggregated trend and statistical analysis, and for showing you more relevant advertisements and messages.     When you use our Services, we may infer the generic physical location and geographic regions of your device from your Wi-Fi, Bluetooth and other device settings. For example, your IP address may indicate your general geographic region. Upon your permission, we may collect your mobile device’s precise geo-location to find the closest property near you. You may choose not to share your location details with us by adjusting your mobile or desktop device’s location services settings. For instructions on changing the relevant settings, please contact your service provider or device manufacturer.

    Other Sources. We also collect reservation information about you from other persons/entities, including travel agents, meeting planners, websites not owned and operated by Omni, and persons/entities booking on your behalf, such as a family member, your employer, or representatives of a company, association, or other organization in connection with a group event that you are attending. We may obtain information about you from social media pages such as when you make a comment on one of our social media pages, or other publicly available information such as your profile photo. We use this information to improve our services to you and to other customers.

    We use the information we collect from you when you make a room reservation primarily to fulfill your hotel reservations, including indicated preferences, and to provide and manage our loyalty program. This may include communicating with you before your stay, and sending you post-stay communications.

  • Loyalty Program

    Directly From You. If you register to participate in our loyalty program, we may collect the following information during your enrollment and participation in the program, including your name, gender, birthday, email address, home and business address, phone number, payment card information; your membership number and password; information that you choose to provide in your loyalty profile, such as your personal stay and destination preferences, spouse/partner name, birthday and/or anniversary; communications preferences; and your stays at Omni properties.  We may obtain information about you from friends if they refer you to us.

    Automatically and Other Sources.  We may also collect information from you automatically and from other sources, as described above in the Room Reservations section, such as the data you make available by linking your loyalty account and social media account(s). 

    We use this information to operate and provide services in connection with our loyalty program. We also use your information to improve our products and services.

  • Spa, Golf, Wedding, Events and Other Experiences. If you visit our Site and book a spa treatment, book one of Omni’s signature experiences, make golf reservations, or reserve space for a wedding or an event, we may collect information regarding the experience you are interested in booking.We use this information to operate and provide the services to you. We also use your information to improve our products and services.

  • Video Recordings/CCTV. We may use closed-circuit television, video recordings, photography, or similar technologies (collectively “CCTV”) to monitor certain Omni properties for security, fraud, loss prevention, incident reporting, and operational purposes. Some of other loss prevention officers and other security personnel may wear body  cameras that collect images, video and audio data.  We use CCTV and body cameras to protect our visitors and have limited such use to public locations where visitors do not have an expectation to privacy. 
  • Omni Gift Card.When you order an Omni gift card, we collect your contact information and payment information, and the recipient name and recipient email. You are required to provide this information in order to complete a purchase. If you choose not to provide this information we may be unable to complete your request. If you provide personal information to us about other persons we ask that you obtain their approval to disclose their personal information to us and to direct them to read this Privacy Policy for information about how we use their information. You are required to provide this information in order to complete a purchase. If you choose not to provide this information we may be unable to complete your request.
  • Customer Care.When you contact customer care with an issue we will collect your name and email address, as well as any other content that you send to us in order to reply and address your issue. If you choose not to provide this information, we may be unable to assist with your issue or question.
  • Newsletters and Alerts Sign Up. You may be able to sign up through the Services to receive electronic newsletters, marketing and promotional emails from Omni including special offers and event information. To sign up, we may ask you for information such as your name, email address, postal address, telephone number and email preferences. We use this information to send you information about our offers and events. We may also use this information to tailor our newsletters to reflect your preferences. You can choose at any time not to receive marketing emails from us by clicking on the unsubscribe link within our marketing emails.
  • Promotional Activity, Contest, or Sweepstakes (“Promotion”). If you choose to participate in a Promotion through our Services, we will collect and store the personal information you provide in connection with your participation in the Promotion, which may include, your name, date of birth, postal address, email address, phone number, and/or other personal information identified in the Promotion terms and conditions or official rules. We use the information you provide to administer our Promotions. We also may use the information to communicate with you about our products, services, and other Promotions.
  • Feedback or Surveys. We may provide you the opportunity to participate in surveys or provide feedback about your experience. If you participate, we may request certain personal information from you, typically including contact information (such as name and email address). Participation in these surveys is entirely voluntary. We use this information to improve our services and offerings.
  • Testimonials. We may seek your permission to post your testimonials, written and video, on our Services. If you wish to update or delete your testimonial, you can contact us via methods identified in the “How to Contact Us” section below.
  • Sensitive Information.  When interacting with us in relation to our Services, we may collect certain personal information that is considered sensitive personal information, which may be subject to special processing conditions under the laws applicable in the jurisdiction which you reside.  For instance, we may collect the following:

Unless specifically requested, we ask that you not send us, and you not disclose, on or through the Services or otherwise to us, any sensitive personal information such as Social Security number, passport number, driver’s license number, or other government-issued identification number; financial account details, with or without any information that would permit access to the account, or credit history; or information on race, religion, ethnicity, sexual practices or sexual orientation, medical or health information, genetic or biometric information, political or philosophical beliefs, trade union membership, background check information or criminal records.

  • Vendors. We collect, use, disclose, and otherwise process personal information we receive from individuals, vendors, contractors, service providers, and other organizations and their respective employees and personnel that we interact with in a business-to-business capacity (collectively, “Vendor Personnel”). The types of personal information we may collect, use, or process about Vendor Personnel will depend upon their status as a prospective, current, or former Vendor as well as the nature of our business relationship. In conducting business, we generally collect the following categories of personal information from Vendor Personnel to evaluate their suitability, verify their qualifications and to carry out our procurement activities:
    • Identifier and contact information such as Vendor Personnel’s first and last name, business e-mail address, postal address, and phone number.
    • Professional information such as the Vendor Personnel’s company affiliation, title, rank or other designation they hold with the Vendor.
    • Business financial information such as bank account details, payment methods, and tax ID/tax status number.
    • Due diligence screening information we may choose to conduct due diligence screening, or when permitted by applicable law, background checks, in connection with your engagement with us. The results of the due diligence screening may include personal information we do not already have about you such as information on adverse media, legal issues, criminal records and/or credit history about owners of the Vendor businesses. We may maintain the results and outcomes from both historic and ongoing due diligence screening for compliance purposes.

3.  Why We Collect Your Personal Information

We use personal information only for the purposes described in this Privacy Policy, except if otherwise disclosed to you at the time the data is collected or otherwise authorized by law or by you. We use the personal information that we collect in connection with any of the following:

a)   Operate and Administer Our Services. We may use your personal information to provide you with the Services requested by you or otherwise available at our properties, such as creating and managing your loyalty program account, making reservations, and servicing your orders and use of the goods, services and amenities at our properties.

b)      Provide Customer Support. We collect any information that you provide to us when you contact us to respond to your inquiries and to fulfill your requests. Without your personal information, we cannot respond to you or ensure your continued use and satisfaction of the Services.

c)  Service-Related Communications. We may send you administrative, account-related, or membership-related information to you, for example, privacy policy and terms updates, security updates, weather events, or reminders for your upcoming reservation or other event you are attending. Service-related communications are not promotional in nature. You may not be able to unsubscribe from certain service-related communications, otherwise you may miss important details relating to your account or the Services.

d)      Provide Marketing Communications. Subject to your marketing preferences (which may include consent to marketing under applicable law), sending you special discounts and offers, newsletters or marketing communications we believe may interest you, for our own products and services, or on behalf of our third-party partners in accordance with applicable law. 

e)  Infer Your Interest and Personalize Your Experience. We may process your personal information to personalizing your experience of the Services by presenting products, services, and offers tailored to you. We may use such information to enable you to interact with our Services more easily across devices, or to recommend more relevant content to you. For example, when you enable the social sharing functionalities of your social media account(s) by interacting with our content on or through third-party social networking websites, plug-ins and applications, we may use this information to personalize your experience on our Services and on the third-party social networking websites, plug-ins and applications.

f)       Research and Develop Our Services. We may process your personal information and derive analytical and statistical data to better understand the way you use and interact with our Services, including by carrying out data analysis, audits, fraud monitoring and prevention, internal quality assurance, developing new products, enhancing, improving or modifying our Services, identifying usage trends, auditing use and functionality of our Services, determining the effectiveness of our promotional campaigns, and operating and expanding our business activities.

g)   Administer Promotional Events. When you participate in sweepstakes, contests, and similar promotions, we may process your personal information to administer such activities (each of which may have additional rules and could contain additional information about how we process your personal information). You have the right to decline to provide your consent and, if consent is provided, to withdraw it at any time.

h)      Facilitate Corporate Acquisitions, Mergers and Transactions. We may process any information regarding your account and your use of our Services as is necessary in the context of corporate acquisitions, mergers, or other corporate transactions.

i)       Enforce Compliance with Our Terms, Agreements and Policies. When you access or use our Services, you are bound to our Terms. We may process your personal information when actively monitoring, investigating, preventing, and mitigating any alleged or actual prohibited, illicit or illegal activities on our Services. We may also process your personal information to investigate, prevent or mitigate violations of our internal terms, agreements or policies; enforce our agreements with third parties; recover payments due to us; and protect our and others’ rights, privacy, safety, or property.

j)       Ensure the Security of the Services. We may process your personal information to combat spam, malware, malicious activities, or security risks; improve and enforce our security measures; and to monitor and verify your identity so that unauthorized users do not gain access to your information.

k)   Maintain Legal and Regulatory Compliance. Our Services are subject to certain laws and regulations which may require us to process your personal information. For example, we process your personal information to pay our taxes, to fulfill our business obligations, or as necessary to manage risk as required under applicable law, or to respond to requests by judicial process or governmental agencies.

4.  How We May Disclose Your Personal Information

We may disclose your personal information as follow, as permitted under applicable law:

  1. Vendors and Service Providers. We may disclose personal information to vendors, service providers, contractors, professional advisors, and other entities that need this information to provide services to us, such as: assisting us in e-commerce operations; managing a database of customer information; hosting the Sites; designing and/or operating the Sites’ features; tracking the Sites’ activities and analytics; enabling us to send you special offers or perform other administrative services; delivery and shipping; operating our Customer Solutions Centers; allowing you to participate in live chat on the Site; and other services designed to assist us in maximizing our business potential. These service providers may have access to or process your personal information only for the purpose of providing services to us. 
  2. Business Partners, Sponsors, and Other Third Parties. We may disclose your personal information to business partners, co-sponsors of promotions, and other third parties in order to provide you with Services that may interest you. For example, we may co-sponsor promotions, sweepstakes, or other events with a third party and may share your personal information in connection with these events. If you provide additional information to any of these third parties, such information provided to these third parties will be subject to each third party's privacy practices and policies.
  3. Analytics and Interest-based Advertising PartnersWe use third-party analytics, advertising, and marketing providers to collect information about your use of the Site, see the overall patterns of usage on the Site, deliver advertisements to your social media account based on email addresses, optimize ad performance, and determine whether our advertising is effective. Where permitted by applicable law, we may share your personal information with marketing and advertising partners for targeted advertising purposes, such as matching custom audience or creating lookalike audience on social media or other marketing platforms, so that we can better understand which of our Services may be of interest to you, market our Services to you, and to provide us information necessary to improve our Services.   4. Third-party Content Providers.The Site may contain content that is supplied by third parties, and those third parties may collect personal information when pages from the Sites are served to you. In addition, we may provide links on the Site to facilitate sending a communication from the Site. For example, we may use third parties to facilitate emails, Tweets, or Facebook postings. These third parties may retain any information used or provided in any such communications or activities, and these third parties’ practices are not subject to our Privacy Policy. You should review the applicable third-party privacy policies before using such tools.
  5. Travel Operators or Business Partners. We may share your personal information with other travel operators in order to facilitate a booking you requested, to generate leads in connection with their offers to sell their products to you, to facilitate their understanding of your membership status, exchange history and utilization, or to respond to your inquiry for further information about vacations at resorts.
  6. Message Boards. We may make reviews, message boards, blogs, and other such user-generated content facilities available to users. Any information disclosed in these areas becomes public information and you should always be careful when deciding to disclose your personal information. We are not responsible for privacy practices of other users including website operators to whom personal information is disclosed.
  7. Change in Control. We may disclose your personal information to a third party (e.g., prospective buyers and insolvency practitioners) in connection with any change in control of any part of our business, including, without limitation, merger, consolidation, divestiture, spin-off, purchase of all or a substantial portion of our assets, dissolution, liquidation, administration, receivership or other form of insolvency.
  8. Marketing Partners. Where permitted by applicable law, we may disclose your personal information with marketing and advertising partners including for targeted advertising purposes, such as matching custom audience or creating lookalike audience on social media or other marketing platforms, so that we can better understand which of our Services may be of interest to you, market our Services to you, and to provide us information necessary to improve our Services.
  9. Corporate Group. We may disclose some or all of your personal information with our subsidiaries and corporate affiliates, joint ventures, or other companies under common control with us for the purposes described in this Privacy Policy unless otherwise prohibited by applicable law or by contractual agreement with our vendors, service providers or other third parties.
  10. Disclosure Permitted by Law. We may disclose your personal information to law enforcement authorities, government or public agencies or officials, regulators, and/or to any other person or entity having appropriate legal authority or justification for receipt of your information, if required or permitted to do so by law or legal process, to respond to claims, or to protect our rights, interests, privacy, property or safety, and/or that of our Affiliates, you or other third parties.

5.  Cookies and Similar Tracking Technologies

We and our service providers may automatically collect information from you when you use the Site or Services using “cookies” and other tracking technologies to help us customize your experience and better manage content on our Site, including to: (a) analyze our web traffic using an analytics package; (b) identify whether you already visited any of our affiliated websites; (c) store information about your preferences (e.g., cookie consent); and (d) to recognize when you return to our Site. 

Cookies are small amounts of data that are stored within your computer’s Internet browser and that are accessed and recorded by the websites that you visit so that they can recognize the same browser navigating online at a later time. Information that may be collected by cookies when you use the Site may include, without limitation: the pages you visit within the Site; the date and time of your visit to the Site; the amount of time you spend using the Site; the IP address used to connect your computer to the Internet; and/or your computer and connection information such as your browser type and version, operating system and platform. 

We use different types of cookies and trackers, which include:

  • Strictly Necessary - these trackers support the core functionality of our website, detect and prevent potential fraud and are necessary for a website to function and provide our products and services. These cookies do not gather information about you for marketing purposes.
  • Functional -these trackers are used to recognize you when you return to our Sites and Services (as defined in the Privacy Policy). They remember the choices you make (such as your username, or the region you are in) and the changes you make to text size, fonts and other features you can customize. While these cookies can be disabled, this may result in less functionality during your use of our Sites and Services.
  • Analytical– these trackers allow us and our analytics service providers/processors to count visits and traffic sources, or test new features, so that we can measure and improve the performance of our Sites including as part of our analytics practices to improve the content offered. They help us understand how visitors use our Sites and Services, which site or page the user came from, the number of each user’s visits and how long a user stays on the Sites and Services.
  • Targeted & Marketing Cookies – these trackers may be set through our Sites by our advertising partners to deliver content, including ads, that are relevant to your interests across your devices, based on how you interact with our advertisements or content. They may be used by our advertising partners to build a profile of your interests and to show you relevant ads on other sites. They do not store directly personal information but are based on uniquely identifying your browser and internet device. If you do not allow these trackers, you will experience less targeted advertising.
  • Social Media - these trackers are set by a range of social media partners that we have added to the Site. They are capable of tracking your browser across other sites and building up a profile of your interests. This may impact the content and messages you see on other websites you visit.

We partner with third parties to provide advertising services that are targeted based on your online activities across websites, mobile apps, and devices over time (commonly referred to as “interest-based advertising”). Our advertising partners may collect information about your activities on our Services on your current device and combine it with information about your activities on other websites, mobile apps, and devices. They may collect such information using server logs, cookies, web beacons, tags, pixels, mobile advertising IDs (such as Facebook cookies or Google's Advertising ID), cross-device linking, and similar technologies. For instance, our advertising partners may use the fact that you visited the Site to target advertising to you on other websites and mobile apps on your current device or on other devices you use. They may match your browsers or devices if you log into the same online service on multiple devices or if your devices share similar attributes that support an inference that they are used by the same person or household. This means that information about your activity on websites or apps on your current browser or device may be combined and used with information collected from your other browsers or devices. You can opt out of interest-based advertising in web browsers and mobile apps on your current browser or device by following the instructions below.

You can change your cookie preferences in our Cookie preferences tool, which is also available by clicking on the “Your Privacy Choices” in the footer of the Site. You can choose to visit our Site without cookies, but in some cases certain services, features and functionality may not be available. To visit without cookies, you can configure your browser to reject all cookies or notify you when a cookie is set. Each browser is different, so check the “Help” menu of your browser to learn how to change your cookie preferences.

6.  Third Party Links

The Services may have links to other websites that are not operated by us. We have no control over how these third-party websites may collect your information and no liability for the practices, policies and security measures implemented on these websites. You should read the privacy notices on those other websites before you submit your information through them.

7.  Social Media Pages

We are not responsible for the collection, usage and disclosure policies and practices (including data security) of other organizations, such as Facebook, Instagram, YouTube, Pinterest or LinkedIn, or any other social media platform provider, operating system provider, wireless service provider or device manufacturer, including any personal information you disclose to other organizations through or in connection with our Social Media Pages. Any posts you make on our Social Media Pages may be available to others who use those pages. Never include sensitive personal, financial, or other confidential information such as your social security number, address, phone number or email address when posting or commenting online. Please refer to the privacy policies of our social media partners when you interact with them online.

8Security and Retention

We use commercially reasonable administrative, technical, and physical safeguards to help protect and secure your personal information from unauthorized access, modification, disclosure, or destruction. However, no information system can be 100% secure. As a result, we cannot guarantee the absolute security of your personal information. Moreover, we are not responsible for the security of information that you transmit to the Sites over networks that we do not control, including the Internet and wireless networks.  We are not responsible for circumvention of any privacy settings or security measures contained on our Services or those on third-party websites. Protecting your personal information is also your responsibility and we urge you to take precautions to protect your personal information. If you have reason to believe that your account or any interaction with us is no longer secure please let us know immediately by contacting customer support or as indicated in the Contact Us section at the end of this Privacy Policy.

Our retention periods for personal information are based on business needs and legal requirements. We will keep your personal information for as long as is reasonably necessary for the purposes for which it is collected, for other purposes described in the Privacy Policy, or as may be required by applicable law. For example, we retain your email address and information about your marketing preferences to ensure that we can honor those preferences. If you wish to cancel your loyalty membership or request that we no longer use your information to provide you Services, we may still retain and use your personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

9.  Children’s Privacy

We understand the importance of protecting children’s privacy in the interactive world. Our Site and Apps are not intended for and our Services are not intended to be reserved by individuals under the age of majority in the applicable jurisdictions, unless required by applicable law. Therefore, we do not knowingly process personal information on our Site or Apps from individuals who are minors. If you are a minor, you should not use the Site or Apps and should not send any information about yourself to us, and you should not use the Services at our properties unless accompanied by a parent or guardian. If you are a parent or guardian and you believe that your child has provided us with information without your consent, please contact us at privacy@omnihotels.com and we will take reasonable steps to ensure that such information is deleted from our databases in accordance with applicable law.

10.  Your Choices

We offer you certain choices about how we communicate with you and if you are a registered user you can manage the information in relation to your account. 

  • Correct or Update Your Information. If you have created a user account through our loyalty program, you can access, update and correct the personal information you have provided in connection with your account by logging into your account on the Site (which you can access by clicking on the “Select Guest” in the header)..
  • Change Your Marketing Preferences. We offer you certain choices about how we communicate with you. You can change your marketing preferences by:
    • Using the unsubscribe function in the email you receive from us;
    • Texting STOP in any SMS communication you receive from us; or
    • Contacting us as set forth under the Contact Us section below.

Please note that we may still send you certain communications relating to your account or use of our Services (such as administrative and service announcements), and these transactional account messages may be unaffected if you choose to opt-out from receiving our marketing communications.

11.  Privacy Rights

For individuals in the United States (except California), depending on applicable law where you reside or are located, you may be able to assert certain rights identified below with respect to your personal information. If you are a resident of California, please see Section 12 instead.

If any of the rights listed below are not provided to you under the law that governs the processing of your personal information, we have absolute discretion in providing you with those rights. Please refer to the “What Rights Apply” section below to determine the rights you have in the jurisdiction you reside. Your rights in relation to your personal information are not absolute. Depending upon the applicable law, access to your rights under the applicable law may be denied: (i) when denial of the request is required or authorized by law; (ii) when granting the request would have a negative impact on another’s privacy; (iii) to protect our rights and properties; (iv) where the request is frivolous or vexatious, or for other reasons.

a)   Right to Know/Access. You may have the right to obtain a copy, or a list of categories of the personal information that we hold about you, as well as other supplementary information.

b)  Right to Correct. You may have the right to correct or update any of your personal information in our records and systems that is inaccurate.

c)   Right to Delete. Under certain circumstances, you may have the right to request that we delete the personal information that we hold about you. Submitting a Request to Exercise Your Privacy Rights 

If you are a resident in a state that provides the rights noted above, you can assert your privacy rights by visiting our Privacy Rights Request Form.  You can also access this form by clicking on the “Privacy Requests” link in the website footer, emailing us at guestrelations@omnihotels.com, or by calling us toll-free at 1-866-516-8906 and advising us which privacy rights you would like to exercise. Depending on your state of residence, applicable law may limit how many times per year you may submit a Right to Know/Access.  We may charge a reasonable fee for multiple requests in the same 12-month period, as permitted by law.

To protect your privacy, we must be able to verify your identity to confirm that the rights request came from you. We may contact you by phone or e-mail to verify your request before we can process your request to exercise certain privacy rights. Depending on your request, we will ask for information such as your name, address, an e-mail address or a phone number you have used with us. For certain requests, we may also ask you to provide details about your most recent purchases.

Opting-out of Sales and Targeted Advertising

You can exercise your right to opt-out of sales and targeted advertising by clicking the "Your Privacy Choices" link in the website footer and following the directions in the Your Privacy Choices pop-up screen regarding how to opt-out of sales and targeted advertising. If you previously opted-out and wish to opt-in, you can use the options identified above to change your preferences.

If you are a resident of Colorado, Connecticut, Delaware (as of 1.1.26), Maryland, Minnesota, Montana, New Hampshire, Oregon (as of 1.1.26) or Texas,  you may also opt-out of sales and targeted advertising via cookies by using an opt-out preference signal. The Global Privacy Control signal is currently the only opt-out preference signal we can recognize. We collect the following categories of Sensitive Personal Information (as defined under California law): driver’s license, state identification card, or passport number, account log-in, and health information that you volunteer so we can better provide you with our Services.  

We do not sell your personal information, and we do not share your personal information for cross-contextual advertising purposes without your permission. We do not sell or share (for cross-context behavioral advertising) the personal information of consumers under 16 years of age. We do not process personal information using automated decision-making technology to make any significant decisions about you.

With your consent, we and other third-party marketing and social media partners may use cookies, pixels, or other tracking technologies on our Sites to collect information about your interaction with our Site to deliver advertising to you on third-party websites and apps. If you have consented to this, you can withdraw your consent at any time by clicking on “Your Privacy Choices” in the website footer and switching off the toggle for “Sale and Sharing/Targeted Advertising Cookies” under Manage Cookie Preference in the pop-up window that appears. 

To the extent we process any information about you that is considered sensitive personal information under the CCPA, we do not process it to infer characteristics about you.

Shine the Light. The California Shine the Light law permits California residents that have an established business relationship with us to request certain information regarding our disclosure of certain types of personal information to third parties for their direct marketing purposes during the immediately preceding calendar year. To make such as request, please contact us using the information below, and indicate in your message that you are a California resident making a “Shine the Light” inquiry. This request may be made no more than once per calendar year.

Do Not Track. Your browser may allow you to adjust your browser settings so that “do not track” requests are sent to the websites that you visit. However, since uniform standards for “DNT” signals have not been adopted, we do not disable tracking technology that may be active on the Site in response to any “do not track” requests that we receive from your browser.

13.  Notice of Financial Incentive

We offer customers programs that provide certain perks, rewards, or special promotions, such as the  Select Guest Loyalty Program.  When you sign up for this program, we may ask you to provide your name, contact information (such as email address and/or telephone number). We use your information to operate and provide services in connection with our loyalty program in accordance with our Select Guest Terms and Conditions. We also use your information to improve our products and services.

Because our loyalty program involves the collection of personal information, some programs may be interpreted as a “financial incentive” program under California law or a “bona fide loyalty program” under Colorado law. The value to Omni of your personal information is related to the value of the free or discounted products or services, or other benefits that you obtain or that are provided to you as part of the Program.

The benefits that we provide to members are reasonably related to the value of the member personal information that we collect. Under California law, the value of your personal information to us is related to the value of the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable Program, less the expense related to offering those products, services, and benefits to Program participants.

You may withdraw from participating in loyalty program at any time by contacting us using the methods identified in the “Contact Us” section. Under certain U.S. State laws, members have the right to delete their personal information. However, if you exercise your right to delete your account information, you will no longer be enrolled in our loyalty program and accumulated points will also be deleted.

14.  International Transfers

Omni is based in the United States and has properties in the United States, Canada, and Mexico.  The personal information it collects, including that collected from individuals while they are located in the European Economic Area (EEA), Switzerland or the United Kingdom, will be processed and stored in the United States and in the location of the property of your hotel stay. For example, we may import your personal information into the United States to fulfill our contractual obligations to you. By booking a reservation, or providing your information to Omni, you are transferring information directly to Omni in the United States and the location of the property of your hotel stay, which is a form of processing that you are choosing to undergo. We will take appropriate measures to ensure that cross-border data transfer and the processing of your personal information by Omni comply with the requirements of applicable laws and that such mechanisms are aimed at ensuring an adequate level of protection as regards your personal information under the applicable laws.

15.  Additional Notice to European Economic Area, United Kingdom and Switzerland Users

This section only applies to individuals using or accessing our Services while located in the European Economic Area, the United Kingdom or Switzerland (collectively, the “European Countries”) at the time of personal data collection.  We may ask you to identify which country you are located in when you use or access the Site or our Services, or we may rely on your IP address to identify which country you are located. If any terms in this section conflict with other terms contained in this Privacy Policy, the terms in this section shall apply to individuals in the European Countries.
